LIMITED WARRANTY

This Warranty grants specific legal rights to the user, which may vary depending on the state, country, or province. The manufacturer, hereinafter SEAREBBEL, does not exclude, limit, or suspend any other legal rights the user may have under applicable law. For a full understanding of your rights, you are encouraged to consult the regulations in your place of residence.

Coverage:

This device is warranted against defects in materials or workmanship for a period of two (2) years from the date of purchase (“Warranty Period”). During this period, SEAREBBEL, at its sole discretion, will repair or replace any defective component under normal usage conditions. Repairs or replacements will be provided free of charge for parts and labor. However, the customer shall bear all shipping, handling, and insurance costs for transporting the device to and from authorized technical service centers.

This Limited Warranty does NOT cover:
  • Cosmetic damage such as scratches, dents, or impact marks.
  • Consumable parts (such as batteries), unless due to manufacturing defects
  • Damage from accident, misuse, abuse, water immersion, flooding, fire, or other external causes.
  • Damage from intervention by unauthorized service providers.
  • Damage to devices modified or altered without written consent from SEAREBBEL.
  • Damage from the use of unauthorized cables or connectors.
  • Damage caused by improper installation or contrary to the user manual.
  • Damage from use in explicitly hazardous conditions, such as adverse weather or risk situations.

To the maximum extent permitted by law, the warranties and remedies set forth herein are exclusive and replace any other express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose. If implied warranties cannot be excluded, their duration shall be limited to the term of this limited warranty.

In no event shall SEAREBBEL, its officers, employees, or agents be liable for special, incidental, indirect, or consequential damages, including loss of use or data. Maximum liability shall be limited, in all cases, to the lesser of the price paid for the device or €100.

Warranty Service and Claims:

Claims must be submitted within 30 calendar days from detection of the defect. SEAREBBEL may:
1. Repair the device using new or refurbished parts
2. Replace it with an equivalent or refurbished model
3. Refund

The repaired or replaced device will be covered under a six (6)-month warranty or the remainder of the original warranty period, whichever is longer.

If repair is requested outside the country of purchase, SEAREBBEL does not guarantee the availability of compatible parts. At its discretion, it may offer an equivalent model or request shipment of the device to an authorized center.

Any use, installation, or maintenance not in strict compliance with the user manual may void this warranty.

All costs associated with import/export compliance, customs duties, VAT, transportation, and other related charges shall be borne by the customer.


RESPONSIBILITIES

MobilePilot is a navigation assistant designed to support the person in charge of the vessel, but under no circumstances does it replace their duty of active and constant vigilance.

The ultimate responsibility for navigation, active vigilance, and manual control lies solely with the person operating the vessel. SEAREBBEL does not guarantee the accuracy of chart data or the automated navigation activity.

1. Qualified Operator and Responsibility:

  • MobilePilot must only be operated by individuals who hold the legal authority and required maritime license to command the vessel under applicable law.
  • SEAREBBEL shall not be liable for any damages resulting from a breach of this requirement.

2. Nature of the System:

  • MobilePilot is a navigation assistant designed to support the person in charge of the vessel, but under no circumstances does it replace their duty of active and constant vigilance.
  • SEAREBBEL accepts no responsibility for damages if the user relies on MobilePilot as a substitute for their active watchkeeping.
    Full responsibility for the navigation and safety of the vessel and its occupants remains with the operator.

3. Installation and Configuration:

  • Anyone installing MobilePilot agrees to follow the instructions in the user manual meticulously. Any incident arising from improper installation is the sole responsibility of the installer.
  • SEAREBBEL is not liable for incidents due to incorrect installation, improper configuration, failure to update, or any setup that does not follow the manual’s instructions.

4. Proper Use and Maintenance:

  • The user is solely responsible for any damage or harm that may result from the incorrect, inappropriate, or negligent use of MobilePilot, as well as from failure to follow the installation, usage, maintenance, or safety instructions provided by SEAREBBEL.
    The user expressly acknowledges that the system may experience technical, mechanical, or software failures and fully assumes the risk associated with its use.
  • SEAREBBEL shall under no circumstances be liable for direct, indirect, incidental, or consequential damages arising from the use or inability to use the MobilePilot system.

5. Regulatory Compliance and Maritime Inspections:

  • It is the sole responsibility of the user to ensure the vessel undergoes any required inspections by the competent Maritime Authority, as well as to comply with any other legal obligations.
  • SEAREBBEL shall not be liable for any failure to comply with applicable maritime safety regulations.

6. Mandatory Insurance Coverage:

  • It is the exclusive responsibility of the user to inform their insurance provider in advance about the installation of the system and to ensure it is covered under the policy, in accordance with regulations on recreational boating insurance.
  • SEAREBBEL shall not be held responsible for any partial or total loss of insurance coverage resulting from the installation or use of the MobilePilot system.
