APP Terms of use

This mobile application (hereinafter, the “App” or “Searebbel App”) is an integral part of the MobilePilot navigation assistance system, developed and marketed by SEAREBBEL S.L., with VAT ID B-42842898 and registered office at Carrer Poeta Costa i Llobera, 47, 07300, Inca, Balearic Islands (Spain).

By accessing, downloading, using, or browsing this App, the user expressly accepts these Terms of Use. If you do not agree with any of these terms, you are advised to refrain from using the App and the MobilePilot system.

1. Purpose

The purpose of this App is to enable pairing and management of the MobilePilot navigation assistance system, allowing assisted heading control through wireless connection to the smart electronic steering wheel installed on the vessel. These terms govern its use and establish the resulting responsibilities.

2. Access and Responsible Use
  • Access to and use of the App are free of charge, but subject to the acquisition of the MobilePilot system.
  • SEAREBBEL may modify, restrict, or cancel access to the App at any time and without prior notice.
  • The user shall use the App solely for its intended purpose: navigation assistance on recreational vessels, in a responsible manner and in accordance with applicable laws.
  • The user affirms that they are over 18 years of age and hold the required maritime certification or license necessary to operate the vessel under applicable legislation.
3. Specific Conditions for the MobilePilot System
  • App Functionality:
    The MobilePilot App serves as a support tool for the electronic system installed on the vessel, enabling configuration, control, diagnostics, and monitoring. Its function is strictly limited to assisting the person operating the vessel and does not replace their duty of active vigilance and manual control.
  • Steering Wheel Pairing:
    The user must always ensure a stable and secure connection between the App and the MobilePilot steering wheel by performing all functional checks outlined in the user manual.
4. Essential Usage Limitations

The MobilePilot system must NOT be used:

  • As a substitute for active and constant vigilance of the vessel by the person in charge.
  • On vessels used for commercial or professional purposes without prior written authorization from SEAREBBEL S.L.
  • Under adverse weather conditions, poor visibility, or any situation that may compromise navigational safety.
  • If any looseness, irregularity, strange noise, or abnormal response is detected after installation or during use. In such cases, immediately disconnect the device and contact your point of sale or authorized distributor.
  • In situations with direct or prolonged exposure to conditions that could damage electronic components. Always ensure that all electrical connections are properly protected against moisture and corrosion.
  • If the device shows signs of failure, visible damage to cables or connections, or has suffered any impact or fall that could affect its integrity or functionality.
5. Intellectual and Industrial Property
  • All content and software associated with the App are the exclusive property of SEAREBBEL or of third parties who have authorized its use.
  • Any reproduction, distribution, modification, or exploitation is strictly prohibited without prior written consent from SEAREBBEL.
6. Changes to These Terms
  • SEAREBBEL may update or modify these Terms of Use at any time by publishing them in the App. Continued use of the App after such modifications constitutes automatic acceptance of the new terms.
7. General Limitation of Liability
  • The App and the MobilePilot system are provided “as is.”
    SEAREBBEL shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the system, including but not limited to personal injury or material damage resulting from system failure, GPS signal loss, App malfunction, or communication issues with the smart electronic steering wheel.
  • The user is solely responsible for continuously supervising the correct functioning of the system, maintaining active control and direct oversight of the vessel at all times.
8. Applicable Law and Jurisdiction
  • These Terms of Use are governed by Spanish law.
  • For the resolution of any disputes related to the use of the App or the MobilePilot system, the parties expressly submit to the courts of Palma de Mallorca, waiving any other jurisdiction that may apply.
